The late Col Adekunle Fajuyi and his son, Donald

Concerned stakeholders and contributors to the preservation of the legacy of Nigeria’s national hero, the late Colonel Adekunle Fajuyi, have warned Donald, son of the late Governor of the Old Western Region, not to sell his father’s house, which was rebuilt by Bola Tinubu, Nigeria’s President, Senator Babafemi Ojudu and others.

This is contained in a letter written by the stakeholders’ lawyer, Toyin Oluwasola, Esq.Head of Chambers, Fiduciary Legal Concept, No 5, Onala Layout, Off Adebayo Road, Ado- Ekiti, copies of which were sent to Governor Biodun Abayomi Oyebanji of Ekiti State; Oba (Dr.) Rufus Adeyemo Adejugbe, Ewi of Ado Ekiti; Surviving children of Chief Daniel Fajuyi (Father of Col. Adekunle Fajuyi) and surviving children of Col. Adekunle Fajuyi.

“We write to formally put you on notice and to demand an immediate halt to any ongoing or proposed sale, lease, transfer, or encumbrance of the said property,” the lawyer wrote.

The lawyer went further: “It is on public record that in 2008, Senator Babafemi Ojudu, alongside other well-meaning Nigerians,including President Bola Ahmed Tinubu mobilized funds for the reconstruction and preservation of the said house. The intent, widely publicized and supported, was to restore the building and transform it into a museum and public monument in honor of Col. Adekunle Fajuyi, who paid the ultimate price for the unity of our nation.

“Following the successful rebuilding of the structure, you, as the eldest son of the family, took unilateral possession of the premises. Since then, the intended purpose of the property—as a memorial site open to the public and the community—has been frustrated.

“Please be advised that any attempt to sell, transfer, or in any way dispose of the said property will be met with swift legal action, including but not limited to a suit for injunction, preservation order, and a petition to relevant state and federal heritage bodies.”

LEGAL NOTICE TO CEASE AND DESIST FROM UNAUTHORIZED SALE OR TRANSFER OF PROPERTY LOCATED AT NO. 1 FAJUYI LANE, OKESHA, ADO EKITI

Dear Mr. Fajuyi,

We act on behalf of concerned stakeholders and contributors to the preservation of the legacy of Nigeria’s national hero, the late Colonel Adekunle Fajuyi, who was born and raised in the house located at No. 1 Fajuyi Lane, Okesha, Ado Ekiti, Ekiti State.

We write to formally put you on notice and to demand an immediate halt to any ongoing or proposed sale, lease, transfer, or encumbrance of the said property.

It is on public record that in 2008, Senator Babafemi Ojudu, alongside other well-meaning Nigerians,including President Bola Ahmed Tinubu  mobilized funds for the reconstruction and preservation of the said house. The intent, widely publicized and supported, was to restore the building and transform it into a museum and public monument in honor of Col. It has now come to our attention that you are making moves to sell or otherwise dispose of the property, a move that constitutes a betrayal of public trust, a violation of the intent of donors and stakeholders, and an act that threatens to erase a valuable part of Nigeria’s historical heritage.

Please be advised that any attempt to sell, transfer, or in any way dispose of the said property will be met with swift legal action, including but not limited to a suit for injunction, preservation order, and a petition to relevant state and federal heritage bodies.

We hereby demand that you:

1. Immediately desist from any transaction relating to the sale or transfer of the said property;
2. Engage in open dialogue with the stakeholders and surviving members of the Fajuyi family on the proper use of the house in accordance with its intended purpose;
3. Acknowledge in writing within 14 days of receipt of this notice that no further steps will be taken by you toward alienating the property.

Please treat this as a final warning. Failure to comply will leave us with no option but to seek redress through legal and public channels.
