Two persons who claimed to be members of Nigeria’s leading opposition All Progressives Congress have mounted a legal challenge against the conduct of the party’s governorship primary in Lagos State on 4 December that produced Akinwunmi Ambode as winner.

The case has come before Justice A. Yunusa sitting in the Federal High Court, Lagos.

The judge on Friday ordered that the All Progressives Congress (APC) and other aspirants who did not appear in court that day be served properly with the court papers with substituted means, that is by their last known address.

Justice Yunusu has adjourned further hearing to 16 January for report of service.

In the suit number FHC/L/1857/14, Mr. Femi Oluwatosin and another; all registered members of the party in Lagos State are seeking the order of the court to invalidate the primary elections purportedly conducted by the first second defendant to elect the governorship candidate of the party on December 4, this year.

The petitioners hinged their prayers on the fact that the party did not comply substantially with the provisions of the Article 20 of the Constitution of the party and the Independent national Electoral Commission (INEC)’s regulations in the conduct of the so-called election.

At the Court on Friday, only the INEC, Mr. Tokounbo Wahab and Dr Leke Pitan, were represented by their lawyers.

The Court ordered that the other defendants be served and that the suit will be given accelerated hearing because of its nature.

The plaintiffs were represented by Mr. S. Adeniji.
