The Majority Leader of the Edo State House of Assembly, Philip Shaibu (Etsako West II) and Sunday Aghedo, (Ovia South-West), were Friday arraigned at an Oredo Chief Magistrate Court in Benin, in connection with alleged assault on another member of the Assembly, Abdul-Razak Momoh.

Also arraigned with the lawmakers were Eboise Emmanuel, 38; Promise Ogiso, 23 and Ernest Arasomwan, 26.

The five accused persons are standing trial on a two-count charge of committing felony and assault.

They were alleged to have on October 7, 2014 conspired with themselves and others at large to commit assault occasioning harm and thereby committed an offence punishable under section 516 of the Criminal Code Cap 48, vol. II Laws of the defunct Bendel State of Nigeria 1976, now applicable in Edo State.

The accused persons were specifically alleged to have on the said date unlawfully assaulted one Hon. Momoh Abdul-Razak by hitting him with iron rod on his head which caused him harm and thereby committed an offence punishable under section 355 of the Criminal Code.

Following their arraignment, their Counsel, Joe Odibeli made an oral application for their bail, saying the offence was a bailable offence assuring that the accused persons will not jump bail if granted.

Prosecution Counsel, K. A Dika who did not oppose the bail application, however urged the Court to consider the seriousness of the offence.

The presiding Chief Magistrate grade 1, Peter Asemota granted the two lawmakers bail in self-recognizance with the sum N200,000 each, the 3rd to 5th accused persons were granted bail in the sum of N200,000 and one surety in like sum.

The court ordered that the surety must be gainfully employed and must own a house within the jurisdiction of the court.

Meanwhile, the case been adjourned to October 29, 2014 for hearing.
