This may not be the best of time for the senatorial candidate of the Peoples Democratic Party, PDP, for Ogun East Senatorial District, Buruji Kashamu, as his own colleagues in the party have taken him to the court seeking his disqualification from contesting the 28 March election.

In a suit numbered FCH/AB/CS/19/2015, the two members of the PDP, Dele Ajayi of Ward 08 in Ijebu North Local Government Area as well as Saula Wasiu of Ward 003, Sagamu Local Government Area of Ogun State, are seeking Kashamu’s disqualification at the Federal High Court sitting in Abeokuta asking the court for an order of interlocutory injunction stopping the Independent National Electoral Commission, EFCC, from recognising Kashamu as the candidate of the PDP for the senatorial district in the National Assembly elections.

Apart from this, they want Kashamu’s disqualification from future elections conducted by INEC as contained in a 15-paragraph motion on notice, dated 23 February, in which INEC was joined as third respondent.

Their major grouse is the dented image of the senatorial candidate. They argued that Kashamu, an acclaimed leader of the party in the Southwestern part of Nigeria, had been charged and/convicted of an offence which involves drug trafficking and fraud.

Having been convicted of an offence involving dishonesty, they argued for Kashamu’s qualification as the candidate of the PDP or any other party and therefore adding that he also either presented forged or no certificate to INEC.

They therefore sought Kashamu’s disqualification by virtue of the provisions of Section 66 (1) (c) of the 1999 Constitution, “having been charged and/or convicted of an offence involving drug trafficking and fraud,” while seeking an order setting aside and/or nullifying the nomination of Kashamu, the first respondent, as the PDP’s candidate for Ogun East Senatorial District. The PDP is the second respondent in the suit.

If Kashamu should win the election, the applicants also seek his replacement with the next other candidate who filed and submitted nomination form to apply for and was screened by the party for its primaries.

The court has fixed 4 March for the hearing of the motion on notice.
