A Kubwa Grade 1 Area Court, Abuja, on Monday discharged two men, Magaji Umar, and Haleru Musa, for lack of diligent prosecution.
They were arraiged on two-count charge of joint act and causing grievous hurt.
The judge, Mohammed Marafa discharged the defendants as a result of lack of diligent prosecution of the matter.
Earlier, counsel to the defendants, Moses Ugwummadu, had applied for the case to be struck out for lack of diligent prosecution and series of adjournments.
He said that the case had suffered adjournments since March 2017.
The prosecutor, Babajide Olanipekun, had told the court that one Pastor Philip Ekator of Kubwa, Abuja, reported the matter at the Kubwa Police Station on March 3, 2017.
He said the defendants and others at large acted in a violent manner, armed with cutlasses and sticks and attacked one Clement Okorie of Byazhin, Kubwa, Abuja, on the said date.
He said that the defendants also cut Okorie’s finger and inflicted body injuries on him.
The offences contravened Sections 79 and 247 of the Penal Code.
