An Osogbo Magistrates’ Court in Osun on Tuesday granted bail to two brothers facing charges of alleged conspiracy and defrauding two intending tenants of N120,000.

The accused are: Azeez Owolabi, 48, and Mustapha Owolabi, 55.

The magistrate, Mrs Olubukola Awodele, granted each of the accused bail in the sum of N50, 000 and two sureties each.

Awodele ordered that the sureties must be residing within the court’s jurisdiction.

He added that each of them should produce two passport-sized photographs including an affidavit of means to the court’s registrar as part of their bail conditions.

Earlier, the prosecutor, Sgt. Sunday Ajayi, had told the court that the accused committed the offences between March and April 2017 at Owode area of Osogbo.

Ajayi told the court that the accused conspired together to defraud the complainants: Matthew Oke and Odewale Olayemi of N1200,000.

He said that the accused had promised to complete a four- room apartment in their father’s house to be rented out to the complainants.

The prosecutor said that the accused made the promise after they had collected the sum from the complainants.

The prosecutor said that the accused, however, reneged on their promise by failing to renovate the apartment and also refused to refund the money initially collected from the complainants to them.

He said the offences committed by the accused contravened Sections 517 and 421 of the Criminal Code, Cap 34 vol.11 Laws of Osun , 2003.

The accused, however, pleaded not guilty to the two- count charge.

The magistrate adjourned the case until Aug. 9 for hearing.
