Kidnap kingpin Evans drags Police to court

Suspected kidnap kingpin, Chukwudumeje Onwuamadike, popularly known as Evans on Wednesday filed a fundamental rights enforcement suit against the Nigeria Police Force.

In the suit, Evans asked the court to compel the police to charge him to court immediately or unconditionally release him from custody.

Evans said in a motion ex parte filed before the Federal High Court Lagos that he has been detained by the police since June 10, and subjected to media trial and parade without any court order.

The kidnap suspect listed the Inspector General of Police, the Nigerian Police Force, the Commissioner of Police in Lagos, and the Special Anti-Robbery Squad, Lagos Command as the respondents in the suit.

He accused the Police of committing grave constitutional infraction against him as he ought to have been charged or arraign before the court in accordance with Sections 35 and 36 of the Constitution of the Federal Republic of Nigeria.

Evans’ father, Stephen Onwuamadike, in an affidavit to support the claims of his son also said that he and other family members have been denied access to his the suspect who is in custody of the Police.

He also claimed that Evans lawyers have been denied access to him.

But the police said it is keeping Evans in custody based on a three-month remand warrant it obtained from a Federal High Court in Abuja.

The Police said warrant which was obtained on June 22 to allow for investigation in Nigeria, Ghana and South Africa and can be renewed.
