Disobedience of court order: Lagos businessman faces committal to prison proceeding

A limited liability company, Bluesworth Resources Investment Limited, will on Monday 4th of July, 2016 commence committal to prison proceedings against a Lagos businessman Abiodun Aguda over his alleged failure to obey order made by a Lagos high court.

According to an affidavit sworn to by the operations manager of Bluesworth Resources Investment limited, Mr Lekan Ogunbajo, what led to the committal proceedings started on 27th of April, 2009 when a Lagos high court presided over by justice S O Isola entered judgement in favour of the claimant upon terms of settlement executed by the two parties.

In the said judgement the court ordered Mr Abiodun Aguda’s company, Femab Properties Limited, being the owner of property known as Diamond Estate situate at Sangotedo, Lekki Lagos, Lagos State to make available and assign unto the claimant all its interest in the 4 bedroom Terrace situate at Block 2HouseD,Unit 3,and 3 bedroom situate at Block 2 House B Unit 3 at Diamond Estate Sangotedo Lekki, Lagos, Lagos State.

In addition the court also ordered the defendants to pay the claimant the sum of N10million in full and final settlement of the suit

However the defendants did not pay the N10million until the court ordered garnishee absolute against the defendants.

Meanwhile, despite the fact that the defendants executed an order of approval for Diamond Estate, Sangotedo in favour of the claimant in respect of the property assigned to the claimant and also took the claimant to inspect the property and promised the claimant to complete the property and hand over same to the claimant within, 60 days from November, 2014,the defendants refused to complete the property and failed to hand over same to the claimant till date.

Consequently, the claimant in a Form 49 personally signed by the presiding judge, F.J. Bankole-Oki , the Claimant in the interest to sustain the dignity and administration of Justice is urging the court to commit the defendants to prison for disobeying the order of the court ordering the Femab Property limited and its managing Director Abiodun Aguda to make available and assign unto the claimant all its interest in the 4 Bedroom Terrace situate at Block 2 House Day Unit 3, and 3 Bedroom Terrace situate at Block 2 House By Unit 3 Diamond Estate Sangotedo, Lekki, Lagos State.
